Requesting a listening device detection or an electronic bug detection can expose various amounts of spyware that is concealed within normal products. For example, these types of devices could be a charger for a cellphone or computer with the capability to power your technology and spy on you at the same time, smoke detectors that will function properly, and listening devices that can be installed into products you welcome into your home like flower arrangements.  If the device does not have access to power, it can only be used for the duration of the battery and must be recharged.

Many of these devices can be viewed from your phone or computer in real-time.  Any such device found during a bug sweep can be a standalone device or attached to something familiar within the home or office that would not be noticeable to the eye.  Many are motion activated to save space on the SD card.   There are devices that can track keystrokes on a keyboard, a gps unit installed on your car that provides google map images of where you have been (historical) or where you are (real-time).

Who uses these devices?  People in a custody battle, divorce situations, insecure people in a relationship and sometimes even co-workers or employers.  Are they legal?  Yes, they are legal to purchase and many of the uses are for legal reasons, but when it is installed without authorization or the knowledge of the person being spied upon, then no, it is being used for illegal reasons.

We had a Client who wanted information on a GPS tracking unit for her boyfriend’s car.  She had no legal right to his vehicle, she wasn’t listed as an owner on the registration, they were not co-habituating and in fact, had recently broken off their relationship.  For her, or for us, to put a GPS tracking unit on his car would not be ethical and we declined her request and informed her of the consequences if she did so.

We had a Client whose husband was an alcoholic, residing in the same residence, and both were listed on the registration records.  He would often leave the residence with his children, drive to a liquor store, and drink in the car while taking his kids to various sporting events.  She could never prove he did so, and without involving the children, she wanted such a device installed so she could see where he goes.  Did he in fact drive to a liquor store when the kids were present?  Did he go to bars after work when he claimed to be working late? This would be a situation where installing a GPS unit could assist you on how to know if someone is lying to you.

We had a Client who insisted her husband spoke to another woman when he was in the restroom.  She claimed he would turn up the music to disguise the fact he was on his cellphone.  She wanted some type of listening device that would audio record his activity at the same time.  We knew it was not ethical to install any type of video device in an area that is assumed as private.  Again, in this situation, we offered other services to her that could assist in determining if he was involved with another woman, but financially all she could afford was putting a device in the bathroom.  We did not take the job.

We also had a professional athletic team requesting a sweep for listening devices in the office where possible negotiations would be conducted and needed to ensure the area was clean prior to holding any meetings.

There are good reasons to own and use these types of devices.  And there are good reasons to have a TSCM conducted in the determination if there are such devices installed in your personal space or office that have the capability to overhear your conversations, monitor your activity  and your destinations learned.

Divorce Property Division, Are You Sure You’re Getting Your Half of The Assets? https://www.iiiweb.net/blog/divorce-property-division-getting-your-half/ Wed, 15 Apr 2020 14:43:08 +0000 https://www.iiiweb.net/?p=9262 Divorce Property Division, Are You Sure You’re Getting Your Half of The Assets?There have been many songs written about “Breakups” and “Divorces” where one party is emotionally more affected than the other.  It doesn’t matter if love is lost, someone has an extra marital affair or life choices is the cause, one party may either be surprised by the decision or has seen it coming for a while.  When love is lost, the divorce may be an easy process, but if one party has wronged the other, there may be ramifications for the party who made the decision to quit the marriage. Like the old saying goes:  Hell hath no fury like a woman scorned.1

Men or women may be blind-sided when they are asked for a divorce.  They didn’t realize there were issues in the relationship; having no idea the other party may be involved in a “side fling” and/or have intentions of replacing their spouse immediately after the divorce.  In this type of separation, usually one party has been diligent in moving marital assets.  Hidden assets in divorce is common when one party attempts to hide money, vehicles and at times property ownership that isn’t reported on their financial disclosure statement.  What a surprise when they are deposed, and a good asset investigator has uncovered the hidden assets. 

All 50 states are no fault, but as of this writing only 17 are true no-fault states.  In some states the spouse at fault will surrender a greater share of marital property or asked to pay more alimony.  Indiana is a no-fault state and many clients just want proof of their spouse’s infidelity so they can move on.  Although we have an office in Indiana, we can obtain information in all 50 states.  We receive requests asking us to find the “other woman/man”.  In doing so, we would recommend surveillance upon the party who is accused of the extra-marital affair.  We would request specific dates and times that would be determined upon past activity.  If observation is made of contact with the opposite sex, we would then attempt to identify the individual.  As in a custody surveillance, we would video document all contact (in a public place) of their interaction.  No, we cannot trespass in order to get any video!  But we can document if one person arrives at a location and the length of time spent.

We would also follow this strategy when alcohol or drug addictions are the reason for filing separation and/or divorce.  Is the spouse visiting liquor stores, going to bars, drinking while driving, meeting contacts in order to purchase illegal drugs?

We have worked cases where one party has installed a hidden device that can record audio and video.  In this instance, we can conduct a tscm sweep to sweep for listening devices and video surveillance detection.  Many Client’s attorneys have reported that one party has knowledge of confidential information exchanged between them and their client, which is a strong indication that a spyware/malware may have been installed on a cell phone or a device in the residence.

    First, we take down information from the initial call, so that we have a clear picture of what our Client is requesting to determine what is possible and what is not possible.  From that information we create an Agreement for Services outlining the facts, the investigation to be accomplished, and to our fees.  After execution of the document and any upfront fees paid, we begin.  We keep our Clients updated of our progress throughout the time we work on their case.  We note any changes that need to be made and regroup to make sure the Client’s needs are addressed.  When our investigation has been completed, we provide a written report, with photos and videos if required, along with any supporting documents.  The report will include a summation of our findings along with recommendations, if needed.  We create a breakdown of expenses that coincides with our invoice and all is given to the Client.

    In a case where a spouse is suspected of cheating, we might include surveillance, a Voice Stress Analysis, digital forensics, and a hidden financial asset search.  If your cellphone is bugged it would entail conducting digital forensics.  Background checks could include an asset search.  Process Services may require us to conduct a missing person investigation to locate the individual being served.  Surveillance may require background searches to obtain information beneficial to the case.  And when calling just to ask a question, any of the services above may be utilized depending upon the case.

    If an Investigator is required to be out in the field, we maintain communication with them so that the office is up to date on what is happening.  We can relay to the Client those updates if required.  If the investigation is conducted in-house by one of our professional researchers, we know to be available for our Client should we find a “Red Flag” or uncover information the Client would need ASAP.

    What’s up with individuals hoarding toilet paper, cleaning supplies, or paper products in general, to include various medical supplies needed for health care workers?  How much disinfecting is needed in one household?  We’ve racked our brains here trying to come up with “the” answer, even with our investigative minds, we have failed in solving this toilet paper hoarding issue.  And it seems this is a problem all over the US, not just in our state.  Look online; there are entertaining photos and captions referencing the lack of toilet paper to consumers.  At one time, it was amusing, we had a laugh, but now, the problem has become real for a lot of people.

    I was talking to my 6-year-old granddaughter and she said, don’t worry Grandma, we have one roll of toilet paper and when “the sickness” is gone, we can get more!  Why would hoarders of toilet paper not think of our little ones, the elderly or the families with multiple children?   When reality hits home, that’s when you become more aware of situations that you have never experienced.  I don’t claim to have answers for everybody, and I don’t promise what I can’t deliver, but we do whatever we can within our field to help others in need.

    I love my job; I love helping others to find answers during an emotional time.  I love to dig through unverified information and pull out what is true and what is not.  I hear stories that are heartbreaking, some humorous, and some that even shock me, but I listen.  I have no idea if their need for help will turn into an investigation, all I know is at that moment when someone is pouring their heart and soul out to a stranger, they need to be heard.  I make no comparison to my 6-year-old granddaughter talking about toilet paper and “the sickness” to a divorce or custody case, or someone being accused of something they didn’t do or commit.  What I am saying is that we are all human and what we face as individuals affects us in varying degrees.  Again, when it hits home, when it touches us personally, when we see things for the first time or when we hear stories we react on different levels.

    As a small business working in a field that is now considered non-essential, I will continue to answer calls, work cases, conduct the investigation and I will continue to just listen.  Even if that’s all someone needs; to have their thoughts and feelings heard by a person who does not judge, I will listen.

    Yes, I will make sure my granddaughter has enough toilet paper and make every effort that “the sickness” doesn’t come to her door.

Basically, we attempt to take measures to avoid being negatively affected.

    Searching for answers is what we do daily.  We are constantly perusing databases, making sure we obtain the best information for our Clients.  No, we can’t predict who will win the election, but we can conduct deep background checks. We can’t control the economy, but we can determine if someone has hidden financial assets.  We can verify information obtained from water cooler talks, i.e. if what is said is true or just a rumor, is the candidate running for office covering up negative information, is someone’s spouse cheating, is the cell phone you are using bugged, is someone listening to private conversations, does that employee have an alcohol/drug addiction?

    During times of crisis is when people are taken advantage of.  Emails, texts or calls are made to unsuspecting individuals attempting to obtain personal information to be used unscrupulously.  These requests are made in a manner to deceive us.  We become so immersed in world events that we momentarily let our guard down with the belief someone is trying to help us, when in fact, any information we provide could be used against us.

    Examples:  You may be requested to provide information regarding the following:

    Election Year:  You may be asked your Political Party Preference, to verify your address to determine the correct voting district and/or asked your district, your household income, if any other registered voters are in the household or general information not known to the requester.

    Economy:  You may be asked about your current retirement plan, your mortgage, banking information, job status, etc.  Any request for this information should never be provided to the requester.

    Health:  HIPPA (Health Insurance Portability and Accountability Act) protects us.  We do not have to provide any health information to anyone without our written authorization.  Never, under any circumstances give your information by phone, email or text unless you know for sure who is requesting it.

    Please note, that not all requests are made to find information about us, but we should never talk freely to anyone asking for personal information without first verifying the legitimacy of the requestor.  Pre-texting is a form of getting private information from unsuspecting individuals. The examples above are ways of pre-texting, impersonating an organization to attempt to obtain information not publicly reported and/or attempting to verify information in an unethical manner.

    In this blog we will concentrate on “Custody”:  Usually the court awards custody prior to the final decree when the divorce is final, or at the original custody hearing. When physical custody is awarded to a sole parent it has either been a joint decision or one parent has been proven in court to be unfit.  Unfit could suggest that one parent isn’t financially able to care for the children on a fulltime basis, or that one parent isn’t employed, doesn’t have proper living quarters, etc.  Additionally, unfit could indicate an alcohol or drug addiction, abusive behavior or mental instability.

    What happens when the non-custodial parent files a change of custody?  Our investigation could take different paths depending upon who we are working with, the custodial parent or the non-custodial parent.

    Example of an investigation when we are working with the current custodial parent:  We would request all information as to why the non-custodial parent was denied custody at the time of the divorce or the initial custody hearing.  We would ask if there have been any changes in the life of the custodial parent, i.e. loss of job, relationship issues, change of residency and/or any other reason why the change of custody was requested.  We would also want to know if either parent is being represented by an attorney.  If our perspective Client has retained an attorney, usually our company would be referred by that law firm.  We would want to have “Attorney Client Privilege”, therefore all work product would be sent directly to the attorney and he/she would be our Client.

    If nothing has changed regarding the custodial parent, then the direction of the investigation would only entail the lifestyle of the non-custodial parent and any association they may have with others.  We may run background checks to determine if they are linked to any criminal histories or a civil check for any court litigations.  We may run a driving history that would show any DUI’s (driving ability), and if we are to conduct surveillance, obtain all registered vehicles linked.  If the case required surveillance, we would recommend surveillance be conducted during a visitation period to observe activity.  If they are forbidden to drive, visit a particular entity or person, are not to participate in a certain activity with the child(ren) present, we would video document any activity that would be considered inappropriate behavior.

    Many times, the parent filing for change of custody will continue whatever lifestyle they are living, even under the recommendation of their attorney to be “On their best behavior”.  Therefore, if they drink, they will continue to do so, if they visit a location they are forbidden by the court, they will still visit. We have observed the non-custodial parent to feel they are above being instructed what to do.

    If the court awarded joint physical custody or even visitation and one parent has had a change of lifestyle that would be considered unhealthy or unsafe for the child(ren) we would ask the same questions and conduct the same type of investigation.

    In the event that pornography is alleged by either party, the attorney may request forensic computer data recovery, recover deleted files on phone,  and/or take a lie detector test. 

    The final report would include any documentation obtained from research, the dates and times of surveillance along with still photos to include a copy of the video from observation of any activity.

I blog a lot about truth! It’s my area of my expertise being a private investigator. I have been single; I have been married and I have started a business and with all, I have had the opportunity to easily find the answers to my questions or concerns. I had the tools to determine what was true and what was not. Not so different as being an electrician and fixing wiring problems, or a plumber and unclogging a sink, a financial advisor and investing my hard-earned money, or an attorney with accurate knowledge of the law. But we can’t be experts in all these fields.

    I have Clients who tell me they can get information online about anyone. I don’t doubt they can, but they have no way of knowing the accuracy of the information. Just because you have access to conduct personal background checks, doesn’t mean the results of the search is true. We can all unclog a drain, but to clean a main, we call a plumber. We can change a lightbulb and maybe an outlet, but to re-wire a house, we call an electrician. We can get access to an investment site, but to effectively choose good investments we contact an investment broker. And no one should try to win a lawsuit pro-se if you don’t have any legal experience, call an Attorney. There is a saying, “Jack of All Trades, Master of None”, and when it comes to difficult life situations, don’t be a Jack.

    At one time or another, we have all presented ourselves as having the ability to do something or be something we truly are not qualified to be, or who we are not! It may not be done to be deceptive, but stated to open the door to be let in. Attempting to put our “best foot forward” for a job opportunity or a new relationship. Is there anything wrong in doing that? Ask the employer, who failed to use verified background checks, and hired the employee who wasn’t qualified, ask the new bride who married the man with a lot of debt and a criminal history. Ask the homeowner who allowed a contractor to renovate their home without first running a small business background check and after the initial fees were paid never saw them again. Or ask the man who met a wonderful woman online without conducting any background research only to learn it was all a scam, she was married, she had kids and she had no intention of every developing a relationship with him.     1. A Driving History ~ Yes, to obtain a Driving History on an individual, we must have a valid reason to access the Bureau of Motor Vehicles.  EX:  Civil Litigation or Criminal Defense, Pre-Employment Background check (with authorization to release form signed by the Subject)
    2. Registration Records ~ Yes, We will pull the registration records while we are conducting surveillance to verify if in fact an individual is residing at a specific residence.  We will pull a registration record in the process of serving legal documents when the defendant or witness is dodging service.  We also pull registration records for a Civil Litigation Case to determine when a vehicle was owned by a specific person and/or if they are the current owner.
    3. Marriage and Divorce Records~ Yes, we can obtain copies of Marriage and Divorce Records.  Marriage Records are more difficult as you do not have to be a resident in the state you are getting married.  An example:  Las Vegas, Key West, etc.  When filing for a divorce, most states require the divorce to be filed in the state of residency.
    4. What is the Process of obtaining a Real ID?  Can you help me to obtain the required documents?  We have assisted multiple females in obtaining divorce records to show the name change.  With the Real ID being required this year, anyone who has a change of last name must show the path of the name change(s).  Here is a link for information regarding the requirements of obtaining a “Real ID”  https://upgradedpoints.com/real-id-act
    5. Can you find an Address~ Can you find a Phone Number ~Yes, we can find a person’s address and telephone number.  Whenever you apply for credit, have mail sent, or provide an address through an online application, that information is compiled and reported. If you own a home, then your address is public record.  If you own rental homes, then information is provided as either a situs address or mailing address.  There are cases where an individual is hiding their whereabouts to avoid court proceedings, warrants, and/or are just homeless tend to be more difficult to locate, but are not impossible.
    6. Can you locate someone ~ Yes, we have an excellent record of locating people, an heir, an adopted child, a parent who isn’t paying child support or just a person of interest.  If locating them is not for a legal purpose, we would protect their privacy and inquire if we can provide their contact information or if we could give them the contact information for the person looking for them.
    7. Comprehensive Personal Profile ~ Yes, we use the comprehensive Personal Profile to verify information and to build a foundation for our investigations.  Results differ depending on the state of residency.  We ensure that the individual’s privacy is protected as all personal information is truncated in the report.  A Comprehensive Report can provide current and previous addresses, family members, associates, vehicle information, voter’s registration information, business and corporation links, telephone numbers, emails, UCC Filings, Civil Litigation and Criminal Histories.  We can also ascertain if a death index has been filed on a social security number.  This type of report is very helpful when conducting background checks, litigation research, surveillances, etc.
    8. SSN Trace ~ Yes, we can verify a Social Security Number when we conduct Pre-Employment Background Checks.  Again, the final result is truncated for Privacy, but we can determine if an individual is linked to someone else’s SSN.  We have conducted multiple background checks where we have learned that an illegal alien has utilized another person’s social security number.  In cases where people are married, a spouse’s SSN may be linked to the wife/husband as they have obtained joint credit.  This is not an issue, but when an SSN is utilized by an unknown person, this is an area of concern.
    9. Asset Searches ~ Yes, we can obtain an asset search but there must be validated reasons to do so.  Usually Asset searches are requested by law firms for various reasons:  EX:  Pre-Litigation ~ Are there assets to pay for a wrongful death suit? Are there assets to attach for a civil suit? Is one spouse hiding assets prior to filing for divorce and not reporting the funds to the court.
    10. TSCM ~ Yes, we perform Technical Surveillance Countermeasure Sweeps for Private Residences, Commercial Buildings, small offices and vehicles.  TSCM are conducted as a measure of security.  Prior to any confidential meeting and/or signing of contracts, one party may want to ensure the area is safe and that there are no covert cameras and/or listening devices that could compromise the outcome and the topics of conversation are considered confidential.  We also conduct TSCM if there is an indication that a covert camera or listening device has been installed in a residence or office.  This is especially the case in a divorce situation.
    11. Digital Forensics ~ Yes, we can conduct spyware and malware analysis on any device, i.e. Android or Apple Phones, Desktop Computer, Laptop or any device that can connect to the Internet and can send and receive data.

    When a Client calls for an Investigation, our staff is prepared to answer their questions and understand their concerns. They may ask for surveillance, a lie detector test, a technical or forensic investigation or background information and in each request, we must be prepared to assist them.  We have established ourselves as a “One Stop Shop” so that our Client’s search for information ends with a call to us.

    No one person can conduct every aspect of an investigation, that is why our team members have specific qualifications to include the professionalism and courtesy of the individual answering the phone, to conducting forensic data recovery, and everything in between.

    We continue to educate ourselves and explore new areas of technology.  Everyday we receive inquiry calls that may be a challenge to other private investigative companies, but not for us.  We have built relationships with sources that specialize in obtaining hard to get information.  Our field investigators pride themselves in conducting the most difficult surveillances. Our in-house staff has access to paid databases that provides the most up-to-date information.

    What can be learned?  We have found very little roadblocks that we can’t get around.  There is a saying we  keep in mind, “There are many roads to Roam”, so when we come to a what we believe is a dead end, we discuss what we have found, what we have not found and together as a team we come up with a solution to the problem.  One approach may have obtained information for a case, but another case’s results may need to be tackled in a different manner.  Cases may share similarities and the results may be the same, but working the case requires different tactics.

    Is it True?  The truth may be as simple as conducting a lie detector test or as difficult as determining if an individual is participating in an activity they deny involvement.  The truth in learning if a spouse is faithful, is an employee trustworthy, is someone consuming alcohol while operating a vehicle, has information been deleted off a device to deceive the courts, is there a listening device in a house or office building, are the kids safe when spending time with the non-custodial parent?  In these scenarios, the end goal is to obtain and validate the “Truth”.

    Are there Facts to Support?  Yes and No!  How can that be?  It depends on which side of the fence you are standing or if the attorney is representing the Plaintiff or Defendant.  As an Example, we worked a custody case in which the Client claimed the children’s father consumed alcohol during his weekend visits.  We could not prove consumption of alcohol, but we could prove he made several trips to a liquor store prior to his dates of visitation.  We also proved by video he carried a red solo cup from his apartment door to his vehicle during one of his outings with his children.  Was he consuming alcohol?  We couldn’t prove he drank the purchased alcohol in the presence of his kids and we couldn’t prove the red solo cup contained an alcoholic beverage.  What we obtained from our surveillance was provided to our Client’s attorney on behalf of her legal case.  It would be his/her job to establish the truth.

    Are there Facts to Support?  Yes, we can prove by documentation if someone has a bad driving record, if they have purchased and registered a new vehicle, if they are utilizing an illegal social security number, if they are lying on a lie detector test.  We can also prove if someone has hidden assets they didn’t disclose in discovery.  These types of investigations rely on documented facts, not actions.  When supporting an action case such as infidelity, we must physically observe the individual in an activity they are accused of being a participant.

    Before any action requires a re-action know the truth and obtain the needed support to back it up.

    Example 1: Deletion of Personal Information:
    A Client requested a “dump” of her cellphone.  Dump meaning data extraction. Even though she had backed up the phone to the cloud some photos were not there, and she could not access text messages that she had deleted in a moment of anger from her device. The messages contained attached photos and information

    Example 2: Evidence Needed for Court:
    An attorney requested to have his Client’s phone Cloned. Cloned meaning a Forensic Extraction of Data. He was in the pre-liminary stages of representing his Client in an Employment Sexual Harassment Case. The Employee harassing his Client was a co-worker and in the process of divorce. She had refused any personal relationship with him, but he continued to send text messages, emails and call her after work hours.  Although she demanded he stop the communication, he continued. She had filed a formal complaint with the company, but they were of no assistance.

    Example 3: Metadata:
    A client was accused of causing a personal injury while on vacation. The client stated that they could not have been in the location where the injury occurred and happened to have taken a video at the same time the incident took place. By extracting the video and analyzing the metadata contained within the file we were able to overlay GPS coordinates and time stamps over a digital map to show that the client could not have been responsible for the alleged injury.

    Example 4: Spyware or Malware Analysis:
    There are risks involved when using a cellular device. Outside of the “Health Risks” reported there is a possibility that your device may have had a spyware or malware application installed. Most spyware applications we have found have been installed by having possession of the device. There are applications available to the public, usually sold by a dealer or manufacture outside of the US that have the capability of being installed remotely. This type of spyware is most likely sent as an attachment. We strongly advice our Clients to avoid downloading any attachment or opening an email from a number or email not familiar to them. There are multiple reasons a Client would request an Analysis of their cellular device if they believed spyware has been installed. Infidelity, Divorce, Stalking, and Disgruntled Employees are many reasons why one party would install some type of spyware/malware application on the other party’s phone to be privy to confidential information, text messages, location, contact lists and email communications.

    Example5: Infidelity Reasons:
    Many times, an individual will request an extraction of their spouse’s cell phone. First, you must have authorization to do so, access to the phone and the password, if the phone is password protected. Although the requestors results are not going to be submitted in court, the same procedure is followed for the extraction process so that information (to include deleted data) can be obtained.

    To conduct a spyware analysis or any of the procedures above, we work off the extraction and not the device, therefore our results can be used in court without having any modifications made to the phone. The extracted data is kept in an encrypted format during the process so that your information remains secure.
